Terms of Service

This is a general template and should be reviewed by a licensed attorney before relying on it for legal compliance.

These Terms of Service ("Terms") govern access to and use of sellbuyleads.com (the "Site") and the lead marketplace operated by VILLARENOVA LLC, doing business as SellBuyLeads ("SellBuyLeads," "we," "us," or "our"). By creating an account, purchasing Leads, submitting Leads for sale, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Definitions

"Lead" means a record of consumer-submitted contact and request information made available for purchase on the marketplace. "Buyer" means a registered business that purchases Leads. "Seller" means a registered business or affiliate that submits Leads for sale. "Exclusive Lead" means a Lead sold to a single Buyer only, as indicated at the time of purchase.

Buyer Terms

When you purchase a Lead, you receive the contact information and form data associated with that Lead as displayed at the time of purchase (for example, name, phone number, email, and the vertical-specific details the consumer submitted). Unless a Lead is specifically marked "Exclusive," shared Leads may be sold to up to three (3) Buyers in total, including you. SellBuyLeads makes no guarantee, express or implied, regarding the accuracy of consumer-submitted information beyond what was provided at the point of capture, nor any guarantee that a Lead will convert into a sale, application, or signed contract. Past performance of any Lead category, vertical, or aging tier is not a guarantee of future results.

Buyers are solely responsible for how they contact and use purchased Leads, including compliance with the Telephone Consumer Protection Act ("TCPA"), state telemarketing and do-not-call laws, and any licensing requirements applicable to their industry. Seller Terms

If you submit Leads for sale through SellBuyLeads — whether generated on your own landing pages, through our Partner Program, or otherwise — you represent and warrant that each Lead was collected with proper, documented consumer consent sufficient to satisfy TCPA and applicable state law, and that the data submitted is accurate and was not fabricated, recycled from a prior sale without disclosure, or obtained through deceptive means. SellBuyLeads reserves the right to reject, suspend, or remove any Lead or Seller account that fails our verification checks, is associated with consent or quality complaints, or otherwise violates these Terms. Payment for accepted Leads is processed according to the rates and schedule presented to you at the time of submission.

Refund and Credit Policy

Buyers may request a refund or account credit for an individual Lead within twenty-four (24) hours of purchase if the Lead is demonstrably invalid, meaning one or more of the following applies:

  • The phone number provided is disconnected, invalid, or not in service;
  • The Lead is an exact duplicate of a Lead you have already purchased; or
  • The Lead shows clear evidence of fraudulent or bot-generated submission.

Refund requests must be submitted to support within the 24-hour window with the Lead ID and the basis for the request. Approved refunds are issued as account credit unless otherwise required by law. Leads that were accurately submitted but did not convert into a sale do not qualify for a refund.

Prohibited Uses

You may not use the Site or any Lead purchased through it to:

  • Harass, threaten, or repeatedly contact a consumer after they have asked to stop being contacted;
  • Contact a consumer in a manner that violates the TCPA, the federal Do-Not-Call rules, CAN-SPAM, or any applicable state telemarketing, insurance, or lending law;
  • Resell, redistribute, or otherwise share raw consumer data obtained through the marketplace outside the terms agreed to at purchase (for example, reselling an Exclusive Lead to a third party); or
  • Use the Site to submit fraudulent, fabricated, or non-consented Lead data for sale.

Violation of this section may result in suspension or termination of your account without refund.

Account Terms

Each business is permitted one account unless otherwise agreed in writing. You agree to provide accurate registration and billing information and to keep it up to date. You are responsible for all activity that occurs under your account credentials and must notify us promptly of any unauthorized use.

Limitation of Liability

To the fullest extent permitted by law, SellBuyLeads and VILLARENOVA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost business opportunities, arising out of or related to your use of the Site, purchased or sold Leads, or these Terms. Our total aggregate liability for any claim arising out of these Terms or your use of the Site shall not exceed the amount you paid to SellBuyLeads in the ninety (90) days preceding the claim.

Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court. The arbitration shall be conducted in accordance with the commercial arbitration rules of a mutually agreed arbitration body. You and SellBuyLeads each waive any right to a jury trial or to participate in a class action. These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.

General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. We may update these Terms from time to time; continued use of the Site after changes take effect constitutes acceptance of the revised Terms. These Terms, together with our Privacy Policy and TCPA Compliance page, constitute the entire agreement between you and SellBuyLeads regarding use of the Site.
